Michael Poe

Welcome to the Law Office of Michael Poe


Michael Poe is the owner and president of Michael K. Poe, Pa. He was admitted to the Florida Bar in 1983 after graduating cum laude from Samford University’s Cumberland Law School, where he received numerous awards. He is a member of the Florida Bar, the Brevard County Bar, the Brevard Collaborative Association, a former member of Brevard County Inns-of-Court,  has been certified by the Florida Supreme Court as a family law mediator, and is admitted and qualified to practice law in the Federal District Courts. His undergraduate education is from the University of Florida where he graduated with Honors from the School of Journalism with a major in Public Relations and minor in Marketing.

During his 37 years as an attorney, he has devoted his entire career as a family law attorney. He has litigated, and settled, thousands of divorce case, paternity cases, modifications and other family law cases during the past 36 years. As such, he has vast experience in assisting people through the divorce maze in which  many people find themselves.

Mr. Poe offers his clients effective, customized assistance to resolve their family law issues, which can include:  alimony issues, children issues, division of asset and debt issues, valuation of business issues, division of retirement issues, real property issues, and paternity issues through collaborative divorce, mediation, negotiation and contested litigation methods. As a result Mr. Poe frequently coordinates with business and valuation experts, forensic accountants, vocational experts and mental health experts in an effort to achieve his client’s financial and child sharing goals.

Mr. Poe is adept at both negotiation and litigation. His main priority in his representation is to attain for his clients the best result possible. He respects the importance of reaching agreements for his clients, and because of his negotiation skills, settles the vast majority of his cases, but he is fully prepared to go to trial for his clients and zealously and effectively advocate for their rights. He enjoys the reputation of being  a skilled negotiator and aggressive litigator. As such he has had the opportunity to  represent  persons of all walks of life, including judges, attorneys, doctors, economists, senior officers of major corporations and nationally known celebrities. Mr Poe is a strong proponent of Collaborative Law and Mediation.

Divorces are extremely difficult for all involved. They can result in protracted court battles, sky high legal bills, years of litigation and eternal hard feelings between ex-spouses. THERE ARE BETTER OPTIONS. Even highly agitated couples can reach financial settlements, parenting plans, and other resolutions for their families without the emotional and financial cost of highly contested litigation.
Contested dissolution of marriage actions occur when parties are unable to resolve their legal issues amicably. This would include not only dissolution of marriage actions, but modifications of Final Judgments, paternity actions, contempt actions and Injunctions for Protection as well. Contested divorces can consist of many aspects of a marriage including but not limited to timesharing, child support, alimony, division of property, division of corporate assets, and other aspects of marriages that have to be resolved by the court if the parties cannot agree.
Paternity is the legal establishment of the child’s father. It is a common belief that if a man’s name is on the child’s birth certificate, that establishes him as the father of the child. However, until the Court enters a judgment of paternity, or similar order, the father has no legal rights and the mother cannot obtain child support from the father. A Petition for Paternity must be filed. The petition may be filed by either parent. Normally one parent is seeking child support and the other is seeking timeshareing with the child.
